These terms govern your use of Earwig. By creating an account or using the service, you agree to these terms. If you do not agree, do not use Earwig.
Earwig is a live interview intelligence platform that provides real-time transcription, AI-powered fact-checking, research suggestions, and paper edit tools for journalists, documentary makers, and researchers.
Earwig also includes two connected products: Earwig Marker, for logging footage as you shoot so your markers and notes land in your editing timeline (with an optional free desktop companion, Earwig Sync, that syncs markers into editors such as DaVinci Resolve and Premiere Pro), and Earwig Producer, an AI assistant that helps you structure, film and edit short videos and, if you choose, share them to platforms such as Instagram. Some features rely on third-party AI providers to process the text, audio and video you give them, as described in our Privacy Policy.
The service is provided by Harry Winteringham ("we", "us", "our"), operating as a sole trader under the laws of England and Wales.
We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will make reasonable efforts to notify you of material changes.
You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and for all activity that occurs under it.
Earwig is currently in open beta. Features may change, and we may limit, suspend, or withdraw access at our reasonable discretion during the beta period.

We may suspend or terminate your account if you violate these terms.
You own your content. Transcripts, audio recordings, video and subtitle files, notes, markers, fact-check results, and any other data you create through Earwig remain your intellectual property.
By using the service, you grant us a limited licence to host, store and process your content solely to provide the service to you. This includes streaming your audio to Speechmatics for live transcription, storing your session audio recordings and any uploaded video and generated subtitle files on our infrastructure (Cloudflare R2) so we can transcribe them, keep your audio and footage in sync and let you play them back, and sending transcript or brief text to Anthropic for AI analysis. This licence terminates when you delete your content or your account.
Recording storage and retention. When you record a session, we store the audio (and, where you use those features, video and subtitle files) on our servers, tied to your account, until you delete it. You can delete a recording at any time by deleting the session or your account, and you can enable footage auto-delete so recordings and associated media are removed automatically after a retention period (30 days by default). Full details are in our Privacy Policy.
We do not claim ownership of your content. We do not use your content to train AI models. We do not sell, share, or distribute your content to third parties except as necessary to operate the service as described in our Privacy Policy.
The Earwig name, logo, design, code, and all associated materials are the intellectual property of Harry Winteringham and are protected by copyright and other intellectual property laws.
You may not copy, modify, distribute, or create derivative works based on the Earwig service or brand without prior written consent.
AI-generated outputs (fact-checks, research summaries, suggested questions) are provided as informational tools. We do not guarantee their accuracy and you are responsible for verifying any information before relying on it professionally.
Earwig is provided "as is" and "as available", without warranties of any kind, either express or implied.
We do not warrant that:
You acknowledge that real-time transcription and AI analysis are inherently imperfect technologies. You are responsible for verifying the accuracy of any outputs before using them in published work, legal proceedings, or other consequential contexts.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Our total aggregate liability for any claims arising from or related to the service shall not exceed the amount you paid us in the 12 months preceding the claim, or GBP 100, whichever is greater.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
You are solely responsible for obtaining all necessary consents before recording any conversation using Earwig. Recording laws vary by jurisdiction — in many places, all parties must consent to being recorded.
We are not responsible for any legal consequences arising from your use of the recording or transcription features without proper consent.
Earwig offers a free trial for new users — 7 days, extended to 30 days if you redeem an invite code. No payment card is required to start the trial.
After the trial, continued access to Pro features requires a paid subscription.
On the iOS app (Earwig Pro, auto-renewable subscription):
On the web: subscriptions are processed securely by Stripe; we do not store or access your card details. You can cancel any time via the Stripe billing portal in your account settings.
If your subscription lapses, Pro features are disabled, but your existing sessions, transcripts, and data are retained and remain accessible. You can reactivate any time by subscribing again.
We reserve the right to change pricing with 30 days' notice; existing subscribers will be notified before any change takes effect.
You may stop using Earwig at any time by contacting support@earwig.io to request account deletion.
We may suspend or terminate your access at any time if you breach these terms, or for any other reason with reasonable notice. On termination, your right to use the service ceases immediately.
Sections relating to intellectual property, limitation of liability, disclaimers, and governing law survive termination.
We may update these terms from time to time. Material changes will be communicated via email or a notice within the service. Continued use of Earwig after changes take effect constitutes acceptance of the revised terms.
These terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
From time to time we run competitions where you can share content you have made or logged with Earwig for the chance to win a prize, such as a month of Earwig membership. The following terms apply unless we publish specific rules for a particular competition.
Eligibility. You must be at least 18 years old to enter. No purchase is necessary. Employees of Earwig and their immediate families may not win.
Entering. You enter by sending us your content using the method we describe. By entering you confirm that the content is yours, that you have the rights and any necessary consents from everyone featured in it, and that sharing it with us does not breach anyone else's rights.
Use of your entry. You keep ownership of your content. By entering, you grant us a non-exclusive, royalty-free licence to view your entry in order to run the competition, and, only where you give us permission, to feature it with credit in our marketing and on our channels. You can withdraw permission for future marketing use at any time by contacting us.
Winners. Winners are chosen at our reasonable discretion based on the criteria we publish for each competition. We contact winners using the details they provide; if we cannot reach a winner within a reasonable time, we may select another. Prizes are as described, are not transferable, and there is no cash alternative.
Competitions are run by Earwig and are not sponsored, endorsed or administered by, or associated with, Instagram, Meta or any other platform.
