Terms of Use

These terms govern your use of Earwig. By creating an account or using the service, you agree to these terms. If you do not agree, do not use Earwig.

1. The service

Earwig is a live interview intelligence platform that provides real-time transcription, AI-powered fact-checking, research suggestions, and paper edit tools for journalists, documentary makers, and researchers.

The service is provided by Harry Winteringham ("we", "us", "our"), operating as a sole trader under the laws of England and Wales.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will make reasonable efforts to notify you of material changes.

2. Your account

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and for all activity that occurs under it.

Earwig currently operates on an invite-only basis. Access is granted at our discretion.

You must be at least 18 years old to use the service.

3. Acceptable use

You agree not to:

  • Use Earwig for any unlawful purpose or in violation of any applicable law
  • Record conversations without the consent of all parties where required by law
  • Attempt to gain unauthorised access to the service, other accounts, or our infrastructure
  • Reverse-engineer, decompile, or attempt to extract the source code of the service
  • Use the service to harass, defame, or infringe the rights of others
  • Share your account credentials or allow others to access your account
  • Use automated scripts, bots, or scrapers to access the service
  • Resell, sublicense, or commercially redistribute the service without written permission

We may suspend or terminate your account if you violate these terms.

4. Your content

You own your content. Transcripts, recordings, notes, fact-check results, and any other data you create through Earwig remain your intellectual property.

By using the service, you grant us a limited licence to process your content solely to provide the service to you (e.g., sending transcript text to Speechmatics for transcription and to Anthropic for AI analysis). This licence terminates when you delete your content or your account.

We do not claim ownership of your content. We do not use your content to train AI models. We do not sell, share, or distribute your content to third parties except as necessary to operate the service as described in our Privacy Policy.

5. Intellectual property

The Earwig name, logo, design, code, and all associated materials are the intellectual property of Harry Winteringham and are protected by copyright and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on the Earwig service or brand without prior written consent.

AI-generated outputs (fact-checks, research summaries, suggested questions) are provided as informational tools. We do not guarantee their accuracy and you are responsible for verifying any information before relying on it professionally.

6. Disclaimers

Earwig is provided "as is" and "as available", without warranties of any kind, either express or implied.

We do not warrant that:

  • The service will be uninterrupted, error-free, or available at all times
  • Transcriptions will be 100% accurate
  • AI-generated fact-checks, research, or suggestions will be correct or complete
  • The service will meet your specific requirements

You acknowledge that real-time transcription and AI analysis are inherently imperfect technologies. You are responsible for verifying the accuracy of any outputs before using them in published work, legal proceedings, or other consequential contexts.

7. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data, revenue, or business opportunities
  • Inaccurate transcriptions or AI outputs
  • Service interruptions or downtime
  • Unauthorised access to your account due to your failure to maintain security

Our total aggregate liability for any claims arising from or related to the service shall not exceed the amount you paid us in the 12 months preceding the claim, or GBP 100, whichever is greater.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

8. Recording and consent

You are solely responsible for obtaining all necessary consents before recording any conversation using Earwig. Recording laws vary by jurisdiction — in many places, all parties must consent to being recorded.

We are not responsible for any legal consequences arising from your use of the recording or transcription features without proper consent.

9. Subscriptions and billing

Earwig offers a 15-day free trial for new users. No payment card is required during the trial period.

After the trial, continued access to recording and transcription requires a paid subscription at £24 per month. Payment is processed securely by Stripe. We do not store or access your payment card details.

You can cancel your subscription at any time through the Stripe billing portal, accessible from your account settings. Cancellation takes effect at the end of your current billing period — you retain access until then.

If your subscription lapses or payment fails, recording and transcription will be disabled. Your existing sessions, transcripts, and data will be retained and remain accessible. You can reactivate at any time by subscribing again.

We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified by email before any price change takes effect.

10. Termination

You may stop using Earwig at any time by contacting ask@earwig.io to request account deletion.

We may suspend or terminate your access at any time if you breach these terms, or for any other reason with reasonable notice. On termination, your right to use the service ceases immediately.

Sections relating to intellectual property, limitation of liability, disclaimers, and governing law survive termination.

11. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via email or a notice within the service. Continued use of Earwig after changes take effect constitutes acceptance of the revised terms.

12. Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
